Michael Yon Ripped Off

By John

And not by just anyone, Yon's famous photo of an American soldier and dying Iraqi girl was taken by one of the vilest of the vile print tabloids.

Michael writes:

John,
This horrible magazine, launching this Memorial Day weekend, shows photos of our wounded soldiers and is very anti-military. They indicate that I gave them this photo. I did NOT and never would have. This is flagrant copyright violation.....

Well, no one ever accused the tabloids OR the anti-war crowd of being classy. This is disgraceful on so many levels it's nauseating. I really wish Mike didn't have to constantly fight these battles for the rights to his own intellectual property (he fought -and won- a lengthy battle with the Army for the same photograph last year).

Blackfive has been all over the story. Matt included the following contact information for Shock Magazine:

The number for HFM is (212) 767-6000. Email Shock at shock@neodata.com and inbox@shocku.com.

The offending cover...

Here's some "shocking" reading for Shock Magazine, the US code on copyright infringement.

Please help Mike out. Let Shock Magazine exactly how you feel about copyright violations, and trashy, thieving tabloids as well.

**Update** Michelle is also pressing the Shock Mag clowns.

**Update 2** Shock seems to be moving foward with the issue. Link has a comments section.

Meanwhile, Mike responds...

I agree that this tabloid's theft of Yon's picture is awful. However, I'm honestly surprised to see Yon selling the picture as a print on his website for 180 bucks. Is any of that going to the girl's family?

Justin Gardner   ·  May 25, 2006 06:13 PM

Prediction; 'Shock' magazine won't last 12 months before it folds from poor circulation.

Warren Smith   ·  May 25, 2006 06:46 PM

Justin, what a truly idiotic thing to say.

First of all, if it were, what business is it of yours? Much of the most generous charity is not publicized at all. Those who publicize their giving are motivated more by the desire for good publicity and their own narcissism than by the desire to help the less fortunate.

Secondly, the vast majority of photographers, particularly photojournalists, are lefties. Can you imagine even one of them ever giving any proceeds to the downtrodden and injured in their photos or to the victims' families? Get real.

Your comment says a lot about you and nothing about Yon.

Oh, and I doubt very much that the photo's proceeds are going to buy Yon a big house or fancy car. Much more likely that they're going towards funding the website or the next trip to one of the world's most dangerous zones.

This world needs more Yons and fewer Justins.

While their actions are detestable, I'm actually happy to see this magazine. Launching a publication is supposed to be very expensive, most mags don't generate a profit for their first couple of years but rather just generate debt until they find a nitch market or go under. Their competing with the internet in a market the internet already has cornered. Once they burn through their subscriber provided photos, their going to have to pay for everyone they use. If photographers and other publishers keep their eyes on these guys, they should be able to bleed them white for copyright infringement.

Leave it to the French. Shock is owned by HFM, a US subsidary of the French holding company - lagardere.com.

Another ACLU inspired piece of vile trash.

Michael   ·  May 26, 2006 10:39 AM

I hope that Michael Yon sues this vile french company.
This is a piece of garbage. Everyone should boycott the retailers who carry this french piece of rotted filth.
Leave it to the french to release this on Memorial Day.
Typical frog behaviour, cowardice and france together again.

Great article, though I have some points that I disagree
