According to the Fayetteville Observer, COL James H. Johnson III avoided prison. This is bull shit. . .wrong. . .he should have been in jail for the rest of life. Guess if you are a West Point graduate and your daddy is a General the rules don’t apply. Here is an article from the Stars and Stripes that shows what he pleaded guilty to, what charges were dropped, and what charges he still faced (a couple days old). I am not the only one pissed, see Carl Prine’s Line of Departure where he has two blog posts. Promise I will have more to say.

And yes, based on over 40 years with the Army in all its components and having lived at West Point for 4 years, and with USMA grads in the immediate family: for USMA grads there is quite a better standard. How dare we complain.

What’s really wrong is that he gets to retire, too. Of course, his retired pay will go to repay the 300K fine, and I wonder who will get access to TRICARE–wife 1 or 2?
I saw that– UNBELIEVABLE. Yet more shocking is that five colonels looked out for him instead of the Army. Here’s a question for the Army side of our community: doesn’t a general officer have to sign off on it? And can’t the Chief of Staff step in and say NO?
Yes, a GO has to sign off, but the CG of USAREUR is a West Point graduate guess what it will stick; yes the CSA can step in, but he won’t, he will take care of his West Point homie.
The GCM approving authority can not increase the penalty given by the GCM panel- he can only approve or set aside for the lesser penalty. The penalty is appalling though it rather looks like it was done primarily to protect the guys family rather than him (weak excuse but at least understandable. She was after all the one who did the investigating and was almost as much an aggrieved party as the Army from this scumbag. I could see how a courtmartial panel would look at that and say- is there a way to punish him but not his family?) but if you are going to go trashing the GO because “he’s a West Pointer”- at least get the story straight.
