This gets filed under “The Long War.” Yeah. With stuff like this, it’ll be a very long war indeed.

    Interesting. At least one justice seems to be saying that it’s O.K. to hold them but not to try them unless POTUS seeks additional powers from Congress.

    Well, Solomon2 has it right. The President can go and get further authority from Congress.

    Also, it appears to me that the GC can now be invoked in a way that establishes the detainees are ‘illegal’ combatants and they can be summarily executed, which is what should have been done with them in the first place.

    Not such a big deal. Nobody gets released and there is time for Congress to act.

    I read this as a victory for the rule of law with no real downside operationally. We can continue to hold onto the bad guys until the law gets fixed.

    Wow…Some Senators are more worried about UBL’s drivers(ie the enemy) rights than say the rights of American soldiers being tortured and killed in Iraq. The SCOTUS managed to redefine the Geneva convention also. What a shame.
